Abstract
Il rapporto di lavoro sportivo è stato oggetto di recente rinnovata attenzione legislativa e giurisprudenziale, che pare mettere in parziale discussione l’inquadramento normativo ormai consolidatosi in oltre quarant’anni di vigenza della legge n. 91/1981. Sebbene la relativa entrata in vigore sia stata parzialmente rinviata all’1 gennaio 2023, è recentemente intervenuto il d.lgs. 28 febbraio 2021, n. 36, recante riordino e riforma delle disposizioni in materia di enti sportivi professionistici e dilettantistici, nonché di lavoro sportivo. A differenza di quanto caratterizzava la disciplina precedente, la novella ha voluto disciplinare unitariamente la figura del lavoratore sportivo, secondo una nozione che intende superare la tradizionale distinzione tra settore professionistico e dilettantistico, estendendo le relative tutele giuslavoristiche e assistenziali a coloro che prima erano definiti dilettanti o professionisti di fatto. Il contributo intende richiamare i profili di novità, alla luce delle criticità della normativa previgente, verificando l’impostazione assunta in merito alla tutela della salute dello sportivo anche in altri ordinamenti nazionali.
Abstract
The sports employment relationship has recently been the subject of renewed legislative and jurisprudential attention, which seems to partially question the regulatory framework which has now been consolidated in over forty years of the validity of law no. 91/1981. Although its entry into force has been partially postponed to 1 January 2023, Legislative Decree 28 February 2021, no. 36, laying down the reorganization and reform of the provisions on professional and amateur sports bodies, as well as sports work. Unlike what characterized the previous discipline, the novel wanted to regulate the figure of the sports worker as a unit, according to a notion that intends to overcome the traditional distinction between the professional and amateur sectors, extending the relative labor and welfare law protections to those who were previously defined amateurs. or professionals in fact. The contribution intends to recall the novelty profiles, in light of the criticalities of the previous legislation, verifying the approach taken on the protection of the health of the sportsman also in other national laws.
