Abstract
Il contributo si propone di indagare la natura del termine per l’esercizio dell’azione del Procuratore federale alla luce delle pronunce del Collegio di Garanzia. In assenza di una espressa previsione all’interno del Codice di Giustizia Sportiva del CONI, le interpretazioni oscillano tra la perentorietà ovvero l’ordinatorietà del termine e non sembrano trovare uno stabile equilibrio nemmeno nella recente pronuncia delle sezioni unite del Collegio.
Abstract
The paper aims to examine the nature of the term for the exercise of the action of the Federal Prosecutor in the light of the decisions of the Collegio di Garanzia. In the lack of an express provision within the CONI Sports Justice Code, the interpretations swing between the peremptory or the ordinatory nature of the terms and do not seem to find a stable balance.
