Abstract
Questo lavoro si propone di evidenziare i vantaggi e le opportunità che istituti alternativi alla risoluzione delle controversie (ADR) come, in primis, “la mediazione”, possano agevolare la gestione dei conflitti nel mondo dello sport, dove il fair play tipico delle discipline sportive, spesso lascia il posto a prese di posizione, testardaggine e comportamenti poco civili da credere di poter risolvere solo davanti ad un giudice. Dopo una visione delle diverse esperienze già provate in Italia e all’estero circa l’introduzione di organi e procedure amicali, ci si soffermerà sulla mediazione civile e commerciale, prevista dal D.lgs. n.28/2010, con le recenti modifiche della c.d “Riforma Cartabia”, quale strumento più idoneo ed efficace da poter utilizzare anche nel mondo dello sport.
Abstract
This work aims to highlight the advantages and opportunities that alternative dispute resolution (ADR) institutions such as, first of all, “mediation”, can facilitate the management of conflicts in the world of sport, where the fair play typical of sports, often gives way to positions, stubbornness and uncivilized behavior to believe you can only resolve before a judge. After an overview of the various experiences already tried in Italy and abroad regarding the introduction of friendly bodies and procedures, we will focus on civil and commercial mediation, provided by Legislative Decree no. 28/2010, with the recent amendments of the so-called “Cartabia reform”, as the most suitable and effective tool that can also be used in the world of sport.
