La tutela della concorrenza negli Stati Uniti è realizzata, da un lato, attraverso l’applicazione del principio dell’equilibrio competitivo mediante sistemi che controllano o limitano i compensi riconosciuti dalle franchigie ai propri atleti, nonché tramite le relative sanzioni – Salary Cap e Luxury Tax – e, dall’altro, attraverso meccanismi volti a garantire merito e trasparenza nella selezione dei migliori giocatori, quali Draft e Combine. In Europa, invece, si è rivelato insufficiente un sistema che attribuisca alla giurisprudenza della Corte di giustizia dell’Unione europea il ruolo di controllo sull’applicazione delle norme antitrust in materia sportiva, poiché sono coinvolte questioni – come l’equilibrio competitivo e il merito – che non possono essere risolte sulla sola base delle regole antitrust.

Abstract EN
The protection of the competition in USA is achieved, on one hand, through the application of the principle of competitive balance by virtue of systems that control or limit earnings granted by franchises to their athletes, and related penalties – Salary Cap and Luxury Tax – and, on the other, through mechanisms aimed at ensuring merit and transparency in the selection of the best players (Draft and Combine). In Europe a system assigning the jurisprudence of the European Court of Justice the role of control on the application of the antitrust rules in sports matters has been shown as not enough, being involved issues – like balance and merit – could not be resolved on the basis of the antitrust rules only.
