Abstract
Il contributo si propone di esporre le principali novità introdotte dalla recente modifica alla normativa sciistica, entrata in vigore il 01.01.2022 ad opera del d.lgs. 28 febbraio 2021 n. 40. Il presente elaborato, partendo da una rapida analisi della normativa precedente (e per alcuni aspetti ancora in vigore), offre una comparazione dei principali istituti del settore soffermandosi principalmente sul regime di responsabilità dei gestori e degli utenti ed altresì sui relativi obblighi assicurativi. Infine, particolare attenzione è data al contratto di skipass, offrendo una breve analisi dei casi più rilevanti nel panorama italiano.
Abstract
This article aims to discuss the principal innovations introduced by the recent modification applied to the skiing legislation implemented on the 1st of January 2022 by the d.lgs of the 28th of February 2021, n.40. Starting from a brief assessment of the former 2003 legislation, it is then possible to compare the main amendments with the 2021 legislation, mainly considering the liability regime of ski resort providers and users and the correlated insurance obligations. Last, this article focuses on the ski pass contract, underpinned by a brief analysis of the most relevant case law in the area of Italian’s skiing panorama.
